EU Settlement Scheme Immigration Legal Advice in Scotland
If you are an EU national who wants to continue living in the UK, you must apply to the EU Settlement Scheme before 30 June 2021. Successful applicants will be given either settled or pre-settled status, depending on how long they have lived here. If you have lived in the UK for a continuous period of five years or more
In cases where you have not been in the UK for a continuous period of five years, you will usually be given pre-settled status. You must have started living in the UK by 31 December 2020. Pre-settled status lets you stay in the UK for five years. Once you have five continuous years of residence, you can apply for settled status.
Your rights with settled or pre-settled status
Settled and pre-settled status confer the same rights to live, work and study in the UK. However, the former grants indefinite leave to remain whilst the latter gives only limited leave. This difference could affect you if, for example, you apply for a mortgage or need to leave the UK for extended periods.
